Modification

A Modification is the process in which the homeowner makes an agreement to bring the loan up-to-date by placing all arrears back in the loan and making a new payment plan with the lender. Note that if you are fortunate enough to obtain a modification, you must try not to fall behind again because the bank is not likely to offer another one.

Short Sale

Short sale occurs only if the homeowner owes the lender more than the house is currently worth. A short sale is a process that assists the homeowner in obtaining the lender's permission to sell the home for a lesser amount and the deficiency that the homeowner may owe after the sale is forgiven. Note that in a short sale the lender decides what sale price they will accept, not the homeowner.

STEPS TO FORECLOSURE

(1) First 3 to 6 Months of Nonpayment

After a homeowner fails to pay their mortgage for ninety days, the accelerated clause of their mortgage kicks in, and the lender is allowed to begin the foreclosure process.

(2) Foreclosure Attorney Retained by the Lender

The foreclosure attorney begins the foreclosure process.

The foreclosure attorney will send a formal letter to the homeowner requesting full payment of all past due payments prior to filing a foreclosure lawsuit.

(3) Foreclosure Lawsuit

The foreclosure lawsuit can be served to the homeowner anytime between the 4th and 6th month of non-payment.

It is imperative that the homeowner files a formal response to the complaint.

Failure to do so will result in the acceleration of your foreclosure case in the legal process, which means you will lose your home sooner rather than later.

(4) Preliminary Proceedings in Foreclosure Court

The homeowner's first court appearance is a

mediation conference where the court attempts to assist the homeowner and lender in resolving the matter via modification with plans to resume modified mortgage payments.

(5) Adversarial Proceedings in Foreclosure Court

If the homeowner and lender fail to resolve the outstanding mortgage due, the bank attorney will make a motion to appoint a referee (a person designated to sell your home).

Again, it is imperative that these motions are responded to; if you don't, the lender's motion will automatically be granted.

(6) Judgment Day

Once a referee is appointed, the bank needs to obtain a judgment to sell your home.

The judgment specifies the monies owed by the homeowner, including past due payments, interest and litigation fees.

Once a judgement is signed, your home can be sold.

PASOS DE EJECUCION HIPOTECARIA

(1) 3 a 6 Meses De Falta De Pago

Después de que un propietario no pague su hipoteca durante noventa días, la cláusula acelerada de su préstamo hipotecaria y al prestamista se le permite iniciar el proceso de ejecución hipotecaria si no se paga todos los pagos atrasados.

(5) Procedimientos Adversariales En La Corte De Ejecución Hipotecaria

Una vez más, es imperativo

que se respondan estas mociones, si no lo hace, se otorgará automáticamente la moción del prestamista.

(6) Dia Del Juicio

Una vez que se designa un arbitro, el banco debe obtener un juicio para vender su casa.

El juicio establece el dinero adeudado,

incluyendo los pagos atrasados, los intereses y los honorarios de litigios.

Una vez que se firme el juicio, su casa puede ser vendida.

BEST SOLUTIONS TO STOP FORECLOSE

  • Make your mortgage a priority bill to pay and try not to fall behind;

  • If you are dealing with unforeseen circumstances such as a loss of employment, contact your lender immediately as they may have an alternative payment option.

  • Do not allow arrears to pile up, contact your lender, they are usually willing to work with you.

  • If you cannot afford your home, sell it before your lose it.

  • Most importantly, try to avoid foreclosure by following the steps above.
